Limits Of Liability: Negatives, Prints, Film
We handle all film and negatives as if they were our own. While we take every precaution, the possibility of damage still exists. We subscribe to the industry-wide standard of liability limitation, as set forth by the Photo Marketing Association International in the following statement: “Submitting any film, print, slide or negative for processing, printing or other handling constitutes an agreement by you that any damage or loss by our company, subsidiary or agents will only entitle you to replacement with a like amount of unexposed film and processing. Except for such replacement, the acceptance by our company, subsidiary and/or agent of the film, print, slide or negative is without warranty or liability and recovery for any incidental or consequential damages is excluded.” Excel Photo will credit the film and materials for your packages should any damage occur. Excel Photo is not responsible for loss, damage or delay of shipment caused by the U.S. Postal Service, United Parcel Service, or any other carrier used by Excel Photo to send and/or receive shipments.
Rights To Graphics / Price Change Notification
All graphic designs, layouts and materials produced by Excel Photo remain the sole property of Excel Photo. Any fees charged regarding such services and materials do not transfer the rights of ownership.
Price Changes: Although we have never found it necessary, we reserve the right to change prices and product lines at any time without notice. Such changes will be made only when forced by circumstances beyond our control.
Promotional Samples
Excel Photo encourages the use of sample products in presentations & mailings. We also recommend that you display samples of your own work at each shoot. To assist you, we have adopted the following sample print policy:
All sample prints within reasonable quantities ordered from July 1 through August 1 and from January 1 through March 15 will be free of charge. Please order promotional samples well in advance. In order to take advantage of this free offer, the following criteria must be met: Sample prints must be ordered as a separate job and you must select and provide a cut negative or image file for each sample. Normal production schedules will apply on all promo sample orders. Upon request, Excel Photo will file your sample images for future use.
Graphics setup, plaques, posters and shipping charges will be billed at regular prices. Samples not meeting the sample criteria or those ordered at any other time than the promotional period above will be subject to full price billing and possible delays in production. Avoiding Extra Time Charges Extra time charges can often be avoided by good planning and proper maintenance of your equipment. We realize that there will be the exceptional occasion that will create special handling situations. Please notify us if you are aware of any problems before your job arrives.
In order to minimize these situations and to protect the careful, well-organized photographer, Excel Photo reserves the right to add extra production days and/or extra time charges should your job require special handling. It will be left to the discretion of the lab as to whether or not these charges will be incurred. All extra time charges are billed at the rate of $17.50 per hour with a minimum one (1) hour charge. The following are some circumstances that would result in extra time charges:
Paperwork
The number one reason for delays in production is inadequate paperwork! We cannot stress enough the importance of complete and accurate production forms. If you lack the proper forms, call us to have them faxed or sent to you as fillable PDF forms or download them from our website (www.excelphoto.com), then request that a supply of forms be sent to you. Please be certain that you use current and complete catalog numbers to avoid errors in your order. While copying data from last year’s paperwork may save you time in preparation, it could lead to confusion or delay of your order once the job reaches the lab. Excel Photo cannot be responsible for delays or errors caused by incomplete or inaccurate paperwork.
